B. In order to access some features of our website, you will have to create an account. You may never use another's account without permission. When creating your account, you must provide accurate and complete information. Indemnity
You agree to defend, indemnify and hold harmless HouseTech, its parent corporations, affiliates officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to our Website; (ii) your violation of any term of these Terms of Use; or (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right. Statute of Limitations
YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF RELATED TO USE OF OUR WEBSITE OR THE SERVICE OR THIS AGREEMENT MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.
Waiver and Severability of Terms
The failure of HouseTech to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. If any provision of the Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Agreement remain in full force and effect.
Applicable Law
This site is created and controlled by HouseTech in the State of California. As such, the laws of the State of California will govern these disclaimers, terms and conditions, without giving effect to any principles of conflicts of laws. HouseTech reserves the right to make changes to this site and these disclaimers, terms and conditions at any time.
Dealings with Third Parties
Your correspondence or business dealings with any third parties as a result of your visit and participation in the Service, including, but not limited to, business dealings with real estate agents, mortgage lenders, or insurance carriers, or any other terms, conditions, warranties, representations associated with such dealings, are solely between you and such third party.
