HouseTech Rebate - Terms and Conditions

When you buy a home with HouseTech as your real estate agent, we will pay you a rebate (the “Rebate”) equal to 100% of the total commission, if any, that HouseTech actually receives from the seller(s) and/or listing broker in connection with the purchase. HouseTech will pay the Rebate, if any, by company check within 14 days after the closing of the purchase; provided that: (1) if you request that all or a portion of the Rebate be paid as a credit against your closing costs in the transaction and you provide us sufficient notice of such request, HouseTech will use reasonable efforts to cause the Rebate to be so paid, and (2) if under applicable law HouseTech may not pay the Rebate after closing, but may pay the Rebate at closing, then HouseTech will use reasonable efforts to cause the Rebate to be so paid. Please note that HouseTech will pay the Rebate to the person(s) named as the buyer(s) or borrower(s) on the HUD-1 Closing Statement or equivalent statement.

Notwithstanding the foregoing, this rebate offer is void, and HouseTech has no obligation to pay the Rebate or any portion thereof to the extent prohibited by applicable law or by the mortgage lender(s) financing your transaction. HouseTech is aware that the following states prohibit the payment of consumer rebates in real estate transactions: Alabama, Alaska, Kansas, Louisiana, Mississippi, Missouri, New Jersey, Oklahoma, Oregon, South Dakota, Tennessee and West Virginia. However, this list is not intended to be exhaustive and HouseTech may be prohibited from paying rebates in other states should new regulations or new interpretations of existing regulations so mandate.

Notwithstanding the foregoing, if HouseTech reasonably determines that a Commission Dispute exists or is reasonably likely to occur, then HouseTech may delay paying the Rebate after such Commission Dispute has been resolved to HouseTech’s satisfaction. "Commission Dispute" means any dispute or uncertainty regarding (1) whether HouseTech is entitled to a commission from the seller(s) and/or listing broker, (2) the amount of the commission to be paid to HouseTech, or (3) the manner or timing of payment of such commission. Please note that HouseTech has no obligation to take any action (including filing or defending any arbitration claim) to enforce, collect or establish entitlement to, any commission.

HouseTech’s rebate program is subject to discontinuation or modification by HouseTech at any time; provided, however, that HouseTech will not modify your Rebate with respect to any specific property after you have made an offer on that property.
